Please note, after you purchase a Sleep Coaching Package, you will be required to sign a contract agreeing to the following:
1. Terms of Agreement:
This Agreement comes into effect on (your start date). The Consultant will provide a consultation to the Client regarding the implementation for healthy sleep habits for the Client’s child including the following services for the consulting package purchased:
A one-hour (approximate) Phone/Skype/In Home consultation; customized written sleep plan and strategy to address the individual needs of the Client’s child; and one/two weeks of access to a private forum to submit daily sleep logs. The Client will have access to sleep log feedback from The Consultant twice a day between the hours of 9am and 8pm to begin once the Client notifies the Consultant that the sleep plan has been implemented. Any messages sent after 8PM will be replied to the next morning. Any messages sent after 9am will be responded to that night.
Following the initial Phone/Skype/In Home Consultation, the Client will receive a customized written sleep plan within 48 hours, unless otherwise agreed to between the Consultant and the Client. The Client will have 48 hours to review the sleep plan and have the opportunity to ask questions and clarify any concerns with the Consultant by email. The Client agrees to follow the plan as written and commit to working with the Consultant for a one/two-week period to establish healthy sleep habits of the Client’s child. Following notification from the Client as to when the sleep plan will be implemented, the Consultant will provide support as outlined above to end one/two weeks from the date of implementation of the sleep plan. The Consultant reserves the right to terminate the agreement if the Client breeches any of the terms of this agreement.
2. Consulting with the Client’s Health Care Practitioner:
The Client shall consult with the Client’s pediatrician or family doctor (“health care provider”), about the Client’s intention to sleep train and implement the sleep plan with the Client’s child prior to sleep plan implementation. It is the Client’s responsibility to rule out any underlying medical conditions with the Client’s health care practitioner that may be causing sleep problems (i.e. sleep apnea, ear infection, allergies, asthma, etc.), as well as ensure that the health care practitioner has advised the Client’s child is gaining weight appropriately, is thriving, and that it is appropriate to implement the sleep plan and/or cease night feedings. The Client agrees to notify the Consultant of any medical changes during the sleep training process (i.e. illness, ear infection, etc.) as sleep training should not be implemented unless the child has a “healthy” diagnosis from a health care practitioner.
3. Liability and Disclaimer:
The information provided by the Consultant is neither intended, nor is implied to be a substitute for professional medical advice. This consultation is intended as an educational service. The Client is advised to always seek the advice of a physician or other qualified health care provider with any questions regarding a medical condition or the health and welfare of the Client’s baby, toddler, or child. The Consultant will use reasonable efforts to include up-to-date and accurate information in consults, but makes no representations, warranties, or assurances as to the accuracy, currency, or completeness of the information provided. The Consultant shall not be liable for any damages or injury resulting from the Client’s access to, or inability to access the information discussed, or from the Client’s reliance on any information provided by the Consultant. This consultation may provide references to other materials and resources but the Consultant will have no responsibility for the content of such other references and shall not be liable for any damages or injury arising from that content. The results of the services provided by the Consultant are of a personal nature and dependent on many factors. These factors include but not limited to: the Client’s adherence to the recommendations of the Consultant, the Client’s child’s health, personal history, and household, as such the Consultant does not guarantee any rate of success for the services provided.
4. Payment:
All services remain the property of the Consultant. The price applicable is set as at the date on which the order is placed. The Consultant will provide an invoice outlining all services to be rendered and collect payment in full before the initial consultation with the Client. The Client will have the option to seek additional support from the Consultant if required at a rate dependent upon the level of support being sought. There are no refunds. Credit card information is not stored. Please read the terms and conditions for the payment gateway chosen for the transaction as they are responsible for the transactions made. Once the consultation has begun, NO REFUNDS can be issued. If the Client has to postpone after the start of the consultation due to unforeseen circumstances, the Client may pick up from where you left off (must be completed within one month from start of consultation).
5. Personal/ Confidential Information:
Any personal information you provide will be used only in the provision of services to you. Except as provided herein, the information provided will not be shared with other third parties. The Client agrees to keep the sleep plan provided by the Consultant for the Client’s personal use and will not share the content of the sleep plan with outside parties without written consent from the Consultant, with exception of the Client’s health care provider and any fellow caregivers of the Client’s child.
6. Parent Commitment:
The Client understands that their commitment to this process is absolutely necessary in order to see the results they are hoping for in regard to their child’s sleep.
A. The Client agrees to follow current recommendations from the American Academy of Pediatrics on safe sleep practices at https://www.aap.org/en-us/about-the-aap/Committees-Councils-Sections/ Child-Death-Review/Pages/Safe-Sleep.aspx.
B. The Client understands that the Consultant needs to receive ongoing communication with the Client to provide feedback for the child’s sleep. Client will provide written daily correspondence at www.thesleepranch.com by 9:30am regarding how the child’s night sleep went and by 7:30pm regarding how the child’s day sleep went.
C. The Client shall bring up any concerns, doubts, or confusion in regard to the sleep plan developed with the Consultant and as soon as possible so that they may be addressed constructively.
